Current EU law

There is a recognisable trend worldwide toward the expansion of export control regulations. This includes various non-proliferation agreements and export control regimes intended to stop the proliferation of weapons. Such policies are incorporated in the national legal frameworks of European Community countries by integrating the regulatory provisions - with their annexes and lists – into national and European product lists, for example. These lists are legally binding as Annex I of the European Community Dual Use Regulation and as the export list of Germany’s Foreign Trade Ordinance.

US law is also relevant

American export control laws embody the principle that goods, software and technology originating in the US should be controlled globally. The result is legal stipulations and provisions governing the re-export of US goods from Germany, of German goods that are the direct product of US technology and software (foreign-produced direct product rule), and of German goods with a defined share of controlled US components (de minimis rule). Compliance to German export provisions and approval by the Federal Office of Economics and Export Control (BAFA) do not supersede the obligation to be aware of the US provisions and obtain a US export authorization where needed.
